Nobody can say what anyone's motivation ever is and I have always been perplexed by its use in criminal law. "He had the motive, and the opportunity". I don't really get it either.

That's a crime of passion, in which case you will be able to use the temporary insanity defense ("he / she left me for a younger man / woman and my heart was so broken and I was so temporarily deranged and distraught that I had to kill them both !!!") ... that'll probably lessen your sentence, or at least just put you in a mental hospital (with bars, mind you) for the rest of your life.

What about this:
If someone is found is possession of five grams of crack, he/she is sent to jail.
For a person in possession of cocaine, he / she would have to have to be in possession of at 500 grams.
Crack and cocaine are chemically, identical drugs.
HOWEVER, crack (generally) is used in poor communities by (generally) blacks and other minorities.
COCAINE on the other hand is (generally) used by the middle and upper classes.

So, my point is that of course we can find an example or two of "reverse racism" ... and shout about it, but racism against minorities is far more common than it is against "whitey" ...

I have a question for Donsky- isn't sexual harassment often "speech"? How do you feel about that? People have the right to not be harassed, or do they?
A boss saying "nice ass" etc. seems like freedom of expression, the right to have the opinion on her ass. I know there is more to the standard, but the point is there are many examples where free speech is limited with regard to crime and punishment.

You're right, Rhino, they are both wrong. My point was that while racism has been endemic in our culture for centuries and efforts to alleviate (such as affirmative action, such as legislation against hate speech, efforts that may give an 'edge' to minorities) have been attacked by the white majority as reverse racisim. Which they might be, but in terms of equality, there is still a very long way to go ....
I think, actually, my point is an 'apples and oranges' thing with regard to that particular post, but ... anyway, you get my point. I think.
On the 'nice ass' thing ... I have to admit that I have seen a double standard in the workplace.
I've noticed that some women seem to feel extremely free to say a lot of sexual stuff about guys, while the guys would get fired if they said the same thing.

Well I think the technical hrassment standard has to involve the power differential and a retaliation aspect or create a climate of reduced "rights". I have the right to work, so if I am feeling uncomfortable and it impedes my ability to perform tasks, etc. Or if I feel that not responding to advances will result in something happening- like not getting a promotion.
In other words I don;t think it is as simple as "nice ass" but my point was that crime is crime, and I am victim if you slap me for being handicapped (handicapable), stupid, gay, a latina, a woman, etc.

No, when you slap your wife you should also verbally abuse her, and let her know why she's being slappped, like for example you could say "next time have my dinner ready when i get home bitch" this way she can hopefully get it right next time and you won't have to go through all the trouble of slapping her again.
In the fairness of full disclosure I must admit that I am a notorious "sexual harasser" but I remember back in the day when it was just called flirting. My strategy for avoiding any complaints or lawsuits is that I am incredibly handsome.
There is a big difference between "nice ass" and blow me or you're fired. Sexual chemistry between the sexes is natural and if there is no criminality behind the act I see no problem with it.
